Dakota Access pipeline proposal gains final approval

The Iowa Utilities Board announced on Tuesday that it issued final approval, effective immediately, for Dakota Access’s proposal to construct a new pipeline on land outside of the jurisdiction of the U.S. Army Corps of Engineers.

The Iowa Utilities Board approved the request by a vote of 2-1. The board requested that the general counsel make an order of final review, including a dissent statement.

An “Order Granting Motion” was approved and is final. Under the order, Dakota Access has permission to begin construction in areas where the utility has successfully acquired permits, approvals, easements and authorizations. The utility will still be required to abide by all legal requirements, including providing notices and abiding by local laws. Dakota Access will maintain all risk for construction-related activities.

The board also noted that Dakota Access may be granted permission to move the pipeline if relocation is related to 199 IAC 13.2(a) or 199IAC 13.9 regulations. Dakota Access will be required to filed Pre-Construction Notice verifications if its permit is modified or otherwise reissued as stated in the Ordering Clause No. 3 of the original March 10 Order.

Dakota Access will be held to the Iowa Code chapter 479B standards. Failure to comply may result in the halting of construction until corrections are made.
