Iowa Utilities Board approves pipeline permit for Dakota Access

The Iowa Utilities Board issued a pipeline permit to Dakota Access on Friday for the construction of a hazardous liquid pipeline.

The hazardous liquids permit was issued to Dakota Access, LLC, in Docket No. HLP-2014-0001. An additional permit was issued, titled, “Order Accepting Compliance Filings and Issuing Permit.”

Before construction can commence, however, Dakota Access and the Board agreed that several requirements must be met and approved by the U.S. Army Corps of Engineers and the Iowa Department of Natural Resources. Dakota Access must also file the final version of its Storm Water Pollution Prevention Plan and Unanticipated Discovery Plan before construction can begin.

Among the requirements, Dakota Access has regulations regarding the removal of trees and shrubbery, including only removing trees and shrubbery by hand. Within seven days of the date of issuance, Dakota Access must also submit several documents for record, including a final revised Agricultural Impact Mitigation Plan (AIMP), a revised timeline including the changes required by the board, and a final set of condemnation easement descriptions, including the materials described in the order. Upon completion of the pipeline, Dakota Access is also required to submit maps of the infrastructure and related routes.
